11/22/2006 - Finding a new attorney and a DSS update

Over the past week besides working on my short term disability paperwork I’ve been doing a great deal of research about both my charges, my rights, about CPS and researching attorneys.  After considerable deliberation and discussions with my wife and father, we’ve decided my current attorney just isn’t right for me.  First off he’s an out of town attorney.  His main office is in the large city close by.  The crime I am accused of is being handled by a suburban police department in a smaller town.

My research has shown that selecting an out of town lawyer this isn’t generally a wise move.  It’s far better to get obtain a local attorney as they know the local laws and procedures better, along with having more personal relationships with the DAs office, the police department and the judges.  My current attorney is also very expensive and to be frank even though I make good money (or at least I did) I just can’t afford him.

I’ve done some research on the internet, but the most beneficial thing I did was contact one of my neighbors who is an attorney.  He’s not a defense attorney, but I figured he would be able to at least point me in the right direction.  He provided me with the names of 4 different local attorneys that handle my type of case.  I called each of their offices today and made appointments with them over the next week.

I did meet with another “big city” attorney today as I had already made the appointment.  She acted very interested in my case, took a $65.00 consultation fee and then never called me back nor responded to my calls.  Nice.  This was my first experience with the type of discrimination and treatment I would begin receiving from people, including our closest friends.  So much for innocent until proven guilty.

CPS called

I received a call from our CPS case worker.  To my extreme joy, she informed me that I could begin seeing my family for 3 hours a day starting on Thanksgiving day.  Needless to say with the holidays coming, I was very worried and upset that I might not be able to see my family.  The catch was that I wasn’t allowed to be alone with my kids without my wife around.

Another piece of good news she shared was that the mother and father of the little girl that accused me were also being investigated.  This gave me hope that maybe the truth of this whole situation might be found.  The Police sure didn’t do their job of investigating, so my hope was that CPS might.

Next, I get Indicted by the Grand Jury.
